Post-arrest property seizure (no active criminal charges in this matter) Bronx County, New York Timeline: ~4–5 Months | The Stakes: Following an arrest, the client’s property, including a vehicle, cellphone, and approximately $7,000 in cash, was seized by law enforcement and not returned, creating significant financial and personal hardship. The Strategy: Defense counsel intervened to challenge the continued retention of the client’s property and pursued its release through communication with law enforcement and legal advocacy. | All seized property—including the vehicle, phone, and cash—was successfully returned to the client. |
Domestic violence allegations (strangulation-related investigation) Bronx County, New York Timeline: ~1 Week | The Stakes: The client was under investigation for serious domestic violence allegations and faced potential arrest, prosecution, and significant immigration consequences due to non-citizen status. The Strategy: Defense counsel coordinated a controlled surrender to avoid an arrest scenario and engaged with law enforcement early in the process. Counsel worked with the complainant, who provided an affidavit of non-prosecution, and positioned the case for a favorable resolution prior to formal charges being pursued. | The District Attorney declined to prosecute the case. |
Assault in the Third Degree (domestic violence misdemeanor) Kings County Criminal Court, Brooklyn, New York Timeline: ~1 Year | The Stakes: The client faced misdemeanor domestic violence charges that could have resulted in jail time, probation, and a permanent criminal record. The Strategy: Defense counsel challenged the prosecution’s evidence, including inconsistencies between the allegations and medical records, while preparing the case for hearings and trial. Counsel negotiated a conditional resolution tied to successful completion of an intervention program. | After completing all required APIP sessions, the assault charge was reduced to Disorderly Conduct, a non-criminal violation. |
