Types of DWI Offenses in Nassau County
Drunk driving or driving while impaired by other substances occurs throughout the state and county. In 2023, there were over 30,000 arrests in the state for impaired driving. There were nearly 1,400 arrests in Nassau County in 2024 for operating a vessel while intoxicated or driving while intoxicated. One hundred forty-nine of these arrests were for felony offenses.
In New York state in 2022, one in three vehicle accident fatalities involved a driver with a blood alcohol content (BAC) of 0.08% or higher. This is the basic form of a DWI offense. It’s important to understand the several types of alcohol and drug-impaired driving offenses:
- DWI. This offense is when a driver has a BAC over the legal limit or is operating their vehicle with evidence of intoxication. For most drivers, the legal limit is 0.08% BAC. Commercial drivers have a BAC legal limit of 0.04%.
- Aggravated DWI. This occurs when a driver’s BAC is 0.18% or higher. It is also charged if there is any level of intoxication or impairment when there is a passenger under the age of 15.
- Driving while ability impaired by alcohol (DWAI/Alcohol). This is the offense of driving while there is evidence of impairment, or a driver has a BAC of between 0.05% and 0.07%.
- Driving while ability impaired by drugs (DWAI/Drugs). A DWAI/Drug is charged when a driver operates a vehicle while impaired by a single drug besides alcohol.
- Driving while ability impaired by a combination of drugs or alcohol (DWAI/Combination). This includes multiple combined drugs or drugs combined with alcohol.
- Zero-Tolerance Law. Drivers who are under the age of 21 have different legal limits and can be charged under this law for a BAC of between 0.02% and 0.07%.
- Refusal to take a chemical test. When you have a driver’s license, you have given implied consent to allow chemical tests after an arrest. If you refuse, there can be automatic penalties. This can be charged in addition to any other DWI or DWAI offenses.
Some of these offenses result in only civil fines, while others result in as much as seven years of imprisonment and thousands in fines. Many factors can influence the charges you face, including prior offenses and aggravating factors like causing an accident. Your attorney can walk you through your specific case to help you understand it.
